This impeachment motion filed under Articles 124, 217 and 218 of the Constitution received the support of MPs of various parties including BJP, Congress, TDP, JDU, CPM. In the Upper House, Vice President Jagdeep Dhankhar said that he has received a proposal demanding the removal of Justice Verma, which is signed by more than 50 Rajya Sabha MPs. Rajya Sabha Chairman Jagdeep Dhankhar said that the High Court judge has received notice of more than the required number of MPs to start the process of removing the post. He said that if a proposal comes in a House, the Presiding Officer has the right to accept or dismiss it. But if motion comes on one day in both houses, then it becomes the property of the House.
Adequate support for proposal in both houses of Parliament
Rajya Sabha Chairman Jagdeep Dhankhar said that a three -member committee is formed with the Chief Justice, a Chief Justice of the High Court and a member. After the report of this committee, the speaker or chairman can take a decision on motion. Chairman Jagdeep Dhankhar asked the Secretary General of Rajya Sabha to confirm whether this motion has also come in the Lok Sabha. According to the Constitution, after the President’s order to remove a judge of the Supreme Court or the High Court, it is necessary to pass a resolution signed by at least 100 Lok Sabha or 50 Rajya Sabha MPs. Whether the proposal should be accepted or not, the Speaker or Chairman decides.
Burned notes were found from Justice Yashwant Verma’s residence
There was allegations of misconduct against Justice Yashwant Verma when a large number of burnt notes were recovered after the fire in his Delhi -based government residence on March 15. Then he was a judge in the Delhi High Court. After being surrounded by the cash scandal, the Supreme Court transferred Justice Verma to the Allahabad High Court. With the impeachment motion against him, Parliament will now investigate the matter. Judge Verma has denied being involved in any kind of misconduct.
Supreme Court’s investigation panel considers the case serious
However, a three -member inquiry panel appointed by the Supreme Court found that he and his family had active control over the store room of Justice Verma’s government residence. The panel concluded that this misconduct was so serious that they should be removed from the post. Justice Yashwant Verma has challenged the impeachment motion brought against him in the Supreme Court. He argues that the inquiry committee failed to investigate important facts and violated his rights as a person and a constitutional officer. This episode has created widespread concerns about corruption in the judiciary.
Memorandum submitted to Lok Sabha Speaker on impeachment
MPs submitted a memorandum to the Lok Sabha Speaker Om Birla with a proposal for impeachment. The proposal has been filed under Articles 124, 217 and 218 of the Indian Constitution. Among the MPs signing the proposal, the names of BJP MPs Anurag Singh Thakur, Ravi Shankar Prasad, Rajiv Pratap Rudi are being mentioned in the Lok Sabha, besides PP Chaudhary, Supriya Sule and KC Venugopal etc.
